SPOUSE, COMMON LAW OR CONJUGAL PARTNER:

Spouse visa are the major contributor of immigrants after economic immigration program. This visa class allows a spouse, common law or conjugal partner of a Canadian Permanent Residents or a Citizen, to migrate permanently with work & study rights in Canada. This visa allows an applicant to travel to and from Canada as many times as they wish to till the visa is valid. This visa costs from CAD $ 1080 as government fees. The processing time of this visa application vary as per the country from where they are applying and to supply adequate number of documents as per requirement.

Eligibility criteria:

  • Spouse whom you are married, can be sponsored.
  • Common law partner who has lived for minimum 12 consecutive months in same house at same place.
  • Conjugal Partner must be in relations with sponsor for consecutive 12 months but couldn’t stay together due to cultural or immigration conditions.
  • Sponsor should be inside Canada if a PR or intending to return to Canada if a citizen.
  • Spouse and Sponsor both must be of minimum 18 years old while applying this visa.
  • Applicant must be sponsored by a Canadian citizen, Permanent Resident living in Canada or a registered candidate of Canadian Indian Act.
  • Sponsor must be able to support the partner financially.
  • Neither a sponsor nor a spouse/ partner should be socially dependent on govt assistance.

DEPENDENT CHILD VISA

A child of a Canadian Permanent Residents, Australian Citizen, or a registered Indian living in Canada, under the Canadian Indian Act. Child must be under 22 year of age and should not be married unless migrated under this visa. Alternatively, a child who is above 22 year of age, but unable to support themselves due to medical or physical disability may qualify to be sponsored. These children must be dependent financially on their parent since before the age of 22.
This visa allows an individual coming to Canada as a temporary worker or a Permanent residency holder would get the right to bring their dependent children to live permanently in the country. This program has been specifically designed to facilitate the Canadians to bring their loved ones to Canada to spend quality time with their families and children. This visa costs from CAD $ 150. The processing time of this visa application vary as per the country from where they are applying and to supply adequate number of documents as per requirement.

For being eligible to be sponsored from a Canadian parent, you need to be:

  • A child must be either a biological or adopted by the Canadian national or Permanent Resident.
  • Child should not be married or in common law relationship.
  • Whilst submitting application, a child must be under 22 years of age and the sponsor must be under 18 years.
  • When a child is above the age of 22 years, could be eligible to be sponsored only if they mentally, physically or financially dependent on their parent or guardian.
  • The sponsor must have good ties with Canada and be a responsible citizen or a resident.
  • The sponsor should take responsibility and need to sign one agreement to commit to procure the daily survival needs of child.

For Quebec residents, there would be variation in the rules and policies for sponsor as well as for an applicant.

 

SUPER VISA (TEMPORARY) FOR PARENTS AND GRANDPARENTS

This visa is a temporary visa for the parent of a Canadian PR or citizens to bring their parents to Canada on a faster way. Applicants are required to meet the specific criteria and to with medical and health character requirement. The application would be assessed by the respective case officer at the local office of the current country of residence of applicants. This visa costs from AUD $ 100 and get processed between 05 to 06 months at present.

To be eligible to be sponsored for this visa, sponsor & applicant must be:

  • Be invited or ask an invitation letter from a Canadian child, who is either Permanent Resident or a citizen.
  • Able to provide the valid proof of relationship between the sponsor and the applicants.
  • Whilst submitting application, a sponsor must procure the evidence of their minimum income (LICO).
  • Be able to take care of medical expenses and other petty expenses.
  • The sponsor must have good ties with Canada and be a responsible citizen or a resident.
  • The sponsor should take good care of parents whilst in Canada; morally, socially and financially.
  • Medical and character requirements to be met for applicants.
  • Applicant can work or study in some circumstances.

Length of stay: Since July 04 th 2022, government of Canada has made changes in the terms of stay in Canada on this visa, which may allow the applicants to stay up to 05 years. However, of the Border service officers if they grant visa for 02 years, would remain same in whilst being in Canada.

Alternatively, an applicant may apply for an extension inside Canada, the decision would solely be on the discretion of Case officer.
